Shipping policy

1. Definitions and interpretation

1.1. www.jocosa.com is a website (hereinafter referred to as the "Website") operated by JOCOSA LIMITED, a private limited liability company duly registered in accordance with the Laws of Malta, bearing company registration number C 103600, and having its registered address situated at 183, Argali House, Triq il-Fortizza, Mosta MST 1858, Malta (hereinafter referred to as the "Company").

1.2. The below terms shall have the following meaning for the purposes of this Shipping Policy (hereinafter referred to as the "Policy"):

1.2.1. "Consumer/s" shall refer to any person who makes a purchase of any product through the Website;

1.2.2."we" shall refer to the Company and/or Website;

1.2.3. "Shipment Carrier" shall refer to any third-party service provider responsible for transporting orders from the Company's warehouse to the Consumer;

1.2.4. "Order/s" and/or "Purchase" shall refer to any successful purchase made by a Consumer through the Website

2. Order processing

2.1. Consumers shall place Orders in accordance with the procedure outlined in Clause 4 of the Website's Terms and Conditions.

2.2. Consumers may cancel their Order in accordance with Clause 4.14 of the Website's Terms and Conditions.

2.3. In furtherance to Clause 4 of the Website's Terms and Conditions, Orders shall be processed by the Company within two (2) to three (3) working days i.e. from Monday to Friday excluding public holidays.

2.4. The Company hereby declares that in the event of high volume of orders received, Orders may take longer to be processed, resulting in delays. In such cases, the Company shall inform Consumers accordingly via email.

3. Pricing and delivery

3.1. Prices on the Website are listed in accordance with Clause 5 of the Terms and Conditions of the Website.

3.2. Orders shall only be shipped to designated addresses stipulated by Consumers when placing the Order and delivery to P.O. Boxes shall not be possible.

3.3. Following the confirmation of their Order/s, Consumers shall receive a shipment confirmation as well as a tracking number to track their Order. The tracking number provided shall be active within twenty-four (24) hours of dispatch.

3.4. Products are shipped in separate packages however are received in the same consignment and hence, on the same delivery date.

4. Loss and damages of orders

4.1. In the unlikely event that an Order is lost during shipping or reaches the Consumer damaged the procedure outlined in Clause 6 of the Website's Terms and Conditions shall apply which also provide for the manner in which the Company should be contacted by Consumers.

4.2. Consumers shall keep all packaging materials and the items ordered, even if the latter arrive in a damaged condition, until the Company resolves the issue, since the Company reserves the right to request the return of such damaged items.

5. Changes to shipping policy

5.1. This Policy came into force on the 11.03.2024 and is the first version to be published. The Policy is subject to change in accordance with any updates and/or changes in applicable laws and regulations, so Users are encouraged to review the Policy on a regular basis. The Company however warrants to advise its Registered Users via email and/or notice on the Website itself upon any changes made to the Policy.

6. Governing law and jurisdiction

6.1. This Policy shall be governed and construed in accordance with the Laws of Malta without giving effect to its choice of law provisions in their totality.

6.2. Any dispute arising in relation to any of the provisions herein contained shall be brought before the Consumer Claims Tribunal in Malta. Any unresolved disputes shall then be brought before the Courts of Malta which shall have exclusive jurisdiction.
